Terms of Service

1. Acceptance

These Terms of Service ("Terms") govern your use of the GuapeApp mobile application and the related services operated by Guapetones (the "Service"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy.

2. The Service

GuapeApp is a software product to help families care for their pets, including walk tracking, health records, lost-pet alerts, family sharing, and an AI veterinary assistant ("GuapeAI"). The Service is provided on an "as-is" and "as-available" basis.

3. Eligibility and your account

• You must be at least 13 years old to use the Service.
• You are responsible for the accuracy of the information you provide and for keeping your password secure.
• You are responsible for all activity under your account.
• You may delete your account at any time from Settings → My Profile → Delete account.

4. Subscriptions and in-app purchases

4.1 Free tier and Premium

The Service offers a free tier with the following limits per month: 100 GuapeAI queries, 3 completed walks, 1 walk reminder per pet, no image attachments to GuapeAI. The "Guapetones Pro" Premium subscription removes these limits and unlocks image attachments.

4.2 Available subscriptions

Premium is offered as auto-renewing subscriptions:

• guapetones_pro_monthly — billed monthly.
• guapetones_pro_yearly — billed once per year.

Prices are displayed in your local currency inside the app at the time of purchase.

4.3 Auto-renewal

• Payment is charged to your Apple ID or Google account at confirmation of purchase.
• The subscription automatically renews for the same period and price unless you turn off auto-renewal at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours prior to the end of the current period.

4.4 Cancellation

• You can manage and cancel your subscription at any time from your platform's subscription settings: on iOS open Settings → [your name] → Subscriptions; on Android open the Google Play Store → Profile → Payments & subscriptions → Subscriptions.
• Cancelling stops auto-renewal. You keep Premium access through the end of the period you already paid for.
• Cancellation must be done at least 24 hours before the next billing date.

4.5 Refunds

All refund requests are handled exclusively by Apple App Store or Google Play under their respective refund policies. Guapetones does not process refunds directly.

4.6 Free trials

If we offer a free trial, you will not be charged during the trial. If you do not cancel before the trial ends, you will be charged for the first paid period automatically.

5. User content

You retain ownership of the content you upload to the Service (pet photos, profile photos, vaccine certificates, walk paths). You grant Guapetones a limited, non-exclusive license to host, store, and display this content as needed to operate the Service. You are responsible for the content you upload — do not upload anything you don't have the right to share.

7. Health Connect / Apple Health integration

Guapetones can integrate with Health Connect (Android) and Apple Health (iOS) to record your personal fitness activity (steps, distance, calories burned) during walks. This integration is optional and concerns your data as the human user — not your pet's. See the Privacy Policy for details.

8. Acceptable use

You agree not to:

• Use the Service for any illegal purpose or in violation of any applicable law.
• Attempt to reverse engineer, decompile, or extract source code, except as permitted by law.
• Probe, scan, or test the vulnerability of the Service or bypass any security measure.
• Upload malicious code or content.
• Use the Service to harass, harm, or impersonate others.
• Use the Service to track or share location of people without their consent.

We may suspend or terminate accounts that violate these rules.

9. Intellectual property

The Service, including its software, design, branding, and all related materials, is owned by Guapetones and protected by intellectual-property laws. These Terms grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes.

10. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied. To the maximum extent permitted by law, Guapetones disclaims all warranties of merchantability, fitness for a particular purpose, and non-infringement. Walk-tracking accuracy depends on your device's GPS and OS behavior. AI-assistant output is informational only.

11. Limitation of liability

To the maximum extent permitted by law, Guapetones shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising out of your use of the Service. Our total cumulative liability for any claim arising out of or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Termination

You may stop using the Service at any time. We may suspend or terminate your access to the Service if you breach these Terms or if continued operation becomes commercially unfeasible. Sections that by their nature should survive termination (e.g., intellectual property, disclaimers, limitation of liability) shall survive.

13. Governing law and jurisdiction

These Terms are governed by the laws of the Argentine Republic, without regard to conflict-of-law principles. Any disputes arising out of or related to these Terms shall be submitted to the ordinary courts of the City of Buenos Aires, Argentina, except where applicable law grants you the right to bring claims in your country of residence.

14. Changes to these Terms

We may update these Terms from time to time. If changes are material we will notify you in-app or by email. Your continued use of the Service after changes take effect means you accept the updated Terms.
